Welcome to Indytend — the easiest way to hire bartenders, chefs, and other hospitality pros for your event, with optional alcohol ordering from our partner liquor stores.

These Terms of Service (“Terms”) govern your use of the Indytend website, mobile app, and related services (together, the “Platform”). By creating an account, booking a service, listing your services, or otherwise using Indytend, you agree to these Terms. If you don’t agree, please don’t use the Platform.

1. Who We Are

Indytend, Inc. (“Indytend,” “we,” “us,” “our”) is a Delaware C-Corp with its principal office in Arizona. We operate an online marketplace connecting customers (“Hosts”) with independent service providers (“Providers”) and partner liquor stores (“Vendors”).

We don’t own, employ, or directly manage Providers or Vendors — we provide the tools for you to connect, book, and pay.

2. Eligibility

You may only use Indytend if:

You are at least 18 years old.

You are at least 21 years old to order or handle alcohol through our Platform.

You can legally enter into binding contracts in your jurisdiction.

You comply with all applicable laws (including liquor laws in your state).

3. Your Account

You must create an account to book or list services.

You are responsible for keeping your login information secure.

You agree to provide accurate, up-to-date information, including ID verification when required (e.g., government-issued ID, food handler’s card, Title IV certification for bartenders).

We may suspend or terminate your account if you violate these Terms or applicable laws.

4. Marketplace Rules

For Hosts:

Book only for legitimate events.

Ensure guests consuming alcohol are 21+.

Comply with venue and local regulations.

For Providers:

Maintain valid certifications/licenses.

Deliver the service as advertised.

Use Indytend’s tools for bookings and payments — no side deals.

For Vendors:

Comply with all applicable liquor laws and licensing requirements.

Fulfill alcohol orders as agreed.

5. Booking & Payments

Bookings must be confirmed by the Provider before payment is processed.

Payments are handled through our third-party payment processor (Stripe).

Indytend collects a 10% commission from Hosts and Providers on applicable fees.

For alcohol orders, Indytend collects payment on behalf of the Vendor and remits the balance after commission (where applicable).

Prices are shown before you confirm your booking.

6. Alcohol Orders

Alcohol orders must comply with all applicable laws in your location.

Only individuals 21+ may receive or handle alcohol deliveries.

ID verification may be required upon delivery.

Indytend is not a liquor license holder — alcohol is sold and delivered by licensed Vendors.

If delivery cannot be completed due to failed ID verification, refusal, or absence, no refunds will be given for alcohol.

7. Cancellations & Refunds

Hosts: Refund eligibility depends on the Provider’s cancellation policy shown at booking.

Providers: Cancellations without sufficient notice may affect your account status and payout.

Alcohol orders are non-refundable once confirmed by the Vendor.

8. Disputes Between Users

Indytend is not responsible for disputes between Hosts, Providers, or Vendors. We may help mediate, but final resolution is up to the parties involved.

9. Prohibited Uses

You agree not to:

Violate any laws or regulations.

Misrepresent your identity or certifications.

Circumvent our payment system.

Post false, misleading, or harmful content.

Harass or endanger others.

10. Content & Intellectual Property

Content you upload (photos, menus, profiles) remains yours, but you grant Indytend a worldwide, royalty-free license to use it for operating and marketing the Platform.

The Indytend name, logo, and content are our property and may not be used without permission.

11. Limitation of Liability

Indytend is not liable for the acts, omissions, or performance of any Provider or Vendor.

We make no guarantees about availability, safety, or quality of services.

To the maximum extent permitted by law, Indytend’s total liability is limited to the amount you paid to us in the past 6 months.

12. Indemnification

You agree to defend, indemnify, and hold harmless Indytend, its officers, directors, employees, and agents from any claims or liabilities arising from:

Your use of the Platform.

Your breach of these Terms or applicable laws.

Any injury, damage, or loss caused by your actions.

13. Changes to These Terms

We may update these Terms from time to time. We’ll post the updated version with a new “Last Updated” date. Continued use means you accept the new Terms.

14. Governing Law

These Terms are governed by Delaware law. Any disputes will be resolved through binding arbitration in Delaware, after good-faith mediation.
